User Agreement for Nexa Care Store

Introduction to the User Agreement: Nexa Care Company's online store (referred to as "the Store" or "our Store") welcomes you and informs you that below you will find the terms and conditions governing your use of this store and all the legal implications arising from your use of the Store's online services through this electronic platform. Any person's use of the Nexa Care Company Store, whether as a consumer of the Store's services or products or otherwise, constitutes their acceptance and agreement, with full legal capacity, to all the terms and conditions of this agreement. This agreement confirms your commitment to its terms and conditions and applies to all types of transactions between the consumer and the Nexa Care Company Store. This agreement becomes effective and binding upon your acceptance of it and your registration with the Nexa Care Company Store, in accordance with Article 10 of the Saudi Electronic Transactions Law.

Article 1 - Introduction and Definitions: The preamble above is an integral part of this agreement. The following are the definitions of the key terms used in this agreement: 1- (Nexa Care Store, referred to as the "Store") This definition includes all forms of online store, whether it be an electronic application, a website (https://37celsius-sa.com), or a physical store. 2- (Consumer) The person who engages in e-commerce with the intention of obtaining products or services offered by the Nexa Care Store through its online platform. 3- (Agreement) This term refers to the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.

Article 2 - Consumer's Legal Capacity: 1- The Consumer acknowledges that they possess the legal capacity, as recognized by Sharia and applicable laws, to transact with the Nexa Care Store, or that they are at least eighteen years of age. 2- The Consumer agrees that in the event of a violation of this article, they shall bear the consequences of such violation before third parties.

Article Three - Nature of Obligation: 1- Nexa Care's obligation to consumers is to provide the (service or product). 2- Nexa Care may also provide other services, such as after-sales services or other related services, depending on the nature and type of (service or product) requested by the consumer.

Article Four - Terms of Use: 1- The consumer is obligated to use the Nexa Care online platform in accordance with public morals and the regulations in force in the Kingdom of Saudi Arabia. 2- When purchasing a service or product from Nexa Care, the consumer is obligated not to use that service or product in a manner that violates public morals and the regulations in force in the Kingdom of Saudi Arabia.

Article Five - Accounts and Registration Obligations: Upon applying for membership in the Nexa Care store as a user, you are obligated to disclose specific information and choose a username and password to use when accessing the store's services. By using this service, you agree to the following: 1- You are responsible for maintaining the confidentiality of your account information and password, and you agree to immediately notify Nexa Care of any unauthorized use of your account information or any other breach of your confidential information. 2- Nexa Care will not be liable under any circumstances for any loss you may incur, directly or indirectly, morally or materially, as a result of the disclosure of your username or password. 3- You are responsible for using your Nexa Care account or membership yourself. If someone else uses it, this will be considered evidence that you have authorized them to use the store in your name and on your behalf. 4- You agree to use Nexa Care Medical Store with complete seriousness and integrity. 5- You agree to provide true, accurate, up-to-date, complete, and legal information about yourself as required during registration with Nexa Care Store, and you agree to update your information if it changes or if necessary. 6. Nexa Care Store is committed to handling your personal information and contact details with complete confidentiality. 7. If Nexa Care Store determines that you have provided false, inaccurate, outdated, incomplete, illegal, or otherwise unlawful information, or information that violates the Terms of Use, Nexa Care Store reserves the right to suspend, freeze, or terminate your membership, store, and account on the platform, without prejudice to Nexa Care Store's other rights and legitimate means of recourse and protection of other consumers. 8. In the event of non-compliance with any of the above, Nexa Care Store management reserves the right to suspend or terminate your store or membership, or block your access to the store's services.

Article Six - Electronic Communications and Official Communication Channels: 1. The parties to this agreement agree that communication will be conducted via the email address registered on the platform. 2. The consumer agrees that all agreements, announcements, statements, and other communications provided electronically are equivalent to their written counterparts and constitute valid and legally binding evidence. 3- The consumer agrees to be contacted and notified of any provisions related to this agreement or dealings with them through general messages broadcast by Nexa Care Store management to all consumers or specific store users. 4- The official communication channels for Nexa Care Store are:
